OBJECTIF:
Une quantité importante de données concernant les dommages materno-fœtaux résultant de l’exercice de manœuvres de Kristeller (KM) ou de l’expression utérine (FP) ne sont pas publiées en raison d’implications médico-légales.

MATÉRIAUX ET MÉTHODES:
Pour cette raison, le document rassemble des informations sur l’ampleur réelle des litiges liés aux dommages et blessures causés par la PF. Les auteurs ont entrepris une recherche pour inclure des moteurs de recherche généraux (PubMed-Medline, Cochrane, Embase, Google, GyneWeb) et des bases de données juridiques (De Jure, base de données italienne de mise à jour quotidienne de jurisprudence; Westlaw, Thomson Reuters, , UK Court Ruling Datables).

RÉSULTATS:
Les résultats confirment que ce phénomène est plus étendu qu’il n’apparaît dans les canaux officiels. Plusieurs tribunaux, aussi bien aux États-Unis d’Amérique (États-Unis) que dans les États membres de l’Union européenne, se sont prononcés contre l’utilisation de la manœuvre elle-même, les prestataires de soins de santé qui ont eu recours aux KM ou à la PF lors des accouchements. Étant donné que la pratique de l’expression utérine traditionnelle est courante dans la pratique obstétricale, tout se passe comme s’il existait un grand fossé entre la vie réelle obstétricale et la jurisprudence officielle et les pratiques officielles sanctionnées par les établissements de santé.

CONCLUSIONS :
Les auteurs pensent qu’il serait souhaitable de rédiger des directives ou des recommandations ciblées sur les manœuvres lors de l’accouchement par voie basse, afin de déterminer exactement les types de techniques de manœuvre absolument interdites et les manœuvres à autoriser, et dans quelles conditions leurs application peut-être considérée comme appropriée.

Abstract (English)  :

AIM:
A significant amount of data concerning maternal-fetal damage arising from the exertion of Kristeller maneuvers (KMs) or fundal pressure (FP) go unreleased due to medicolegal implications.

MATERIALS AND METHODS:
For this reason, the paper gathers information as to the real magnitude of litigation related to FP-induced damages and injuries. The authors have undertaken a research in order to include general search engines (PubMed-Medline, Cochrane, Embase, Google, GyneWeb) and legal databases (De Jure, Italian database of jurisprudence daily update; Westlaw, Thomson Reuters, American ruling database and Bailii, UK Court Ruling Database).

RESULTS:
Results confirm said phenomenon to be more wide ranging than it appears through official channels. Several courts of law, both in the United States of America (USA) and in European Union (EU) Member States as well, have ruled against the use of the maneuver itself, assuming a stance conducive to a presumption of guilt against those doctors and healthcare providers who resorted to KMs or FP during deliveries. Given how rife FP is in mainstream obstetric practice, it is as if there were a wide gap between obstetric real-life and what official jurisprudence and healthcare institutions-sanctioned official practices are.

CONCLUSION:
The authors think that it would be desirable to draft specifically targeted guidelines or recommendations on maneuvers during vaginal delivery, in which to point out exactly what kinds of maneuvering techniques are to be absolutely banned and what maneuvers are to be allowed, and under what conditions their application can be considered appropriate.

ALVO:
Uma quantidade significativa de dados sobre danos materno-fetais decorrentes do exercício de manobras de Kristeller (KMs) ou pressão de fundo (FP) não são liberados devido a implicações médico-legais.

MATERIAIS E MÉTODOS:
Por essa razão, o artigo reúne informações sobre a real magnitude do litígio relacionado a danos e lesões causadas por ele. Os autores realizaram uma pesquisa para incluir motores de busca gerais (PubMed-Medline, Cochrane, Embase, Google, GyneWeb) e bancos de dados jurídicos (De Jure, banco de dados italiano de atualização diária jurisprudência; Westlaw, Thomson Reuters, banco de dados americano e Bailii , Banco de dados de decisão do Tribunal do Reino Unido).

RESULTADOS:
Os resultados confirmam que o fenômeno é mais amplo do que parece pelos canais oficiais. Diversos tribunais, tanto nos Estados Unidos da América (EUA) como nos Estados-Membros da União Europeia (UE) também condenaram a utilização da manobra, assumindo uma postura conducente a uma presunção de culpa contra os médicos e prestadores de cuidados de saúde que recorreram a KMs ou FP durante as entregas. Dada a forma como a FP predominante está na prática obstétrica mainstream, é como se houvesse uma grande lacuna entre a vida real obstétrica e o que são as práticas oficiais sancionadas pela jurisprudência oficial e pelas instituições de saúde.

CONCLUSÃO:
Os autores acham que seria desejável esboçar diretrizes específicas ou recomendações sobre manobras durante o parto vaginal, nas quais apontar exatamente quais tipos de técnicas de manobra devem ser absolutamente proibidas e quais manobras devem ser permitidas, e sob quais condições aplicação pode ser considerada apropriada.
