La collaboration entre les sages-femmes et les médecins lors d’un accouchement est plus que fréquente. En cas de contentieux, devant certaines difficultés à rechercher les responsabilités respectives de chacun d’entre eux, l’auteur tente de dégager les solutions émanant des décisions à partir d’une analyse jurisprudentielle. Celles-ci sont divergentes, en raison de l’interprétation du statut que l’on fait de la profession de sage-femme. Les solutions étant gouvernées par le statut ambivalent de la profession de sage-femme, certains jugements décident des cas de responsabilité exclusive de la sage-femme ou du médecin, alors que d’autres reconnaissent des responsabilités partagées entre sage-femme et médecin. Après étude des affaires concernées, l’auteur reste étonné de certaines décisions, notamment dans les cas des responsabilités partagées, et émet l’hypothèse qu’il ne semble pas toujours évident pour les juges de distinguer ce qui relève de la responsabilité de la sage-femme de celle qui relève du médecin. S’il paraît évident que, devant l’indépendance dont jouit la sage-femme dans l’exercice de ses missions, il est logique de la rendre responsable de ses actes, il est toujours surprenant de rendre le médecin responsable d’une mauvaise surveillance de la parturiente ou du nouveau-né par la sage-femme, alors que celle-ci n’a aucun lien de subordination avec lui, chacun devant entrer dans le cadre d’une collaboration de leurs compétences respectives, à charge pour eux de ne faire aucune faute. À l’inverse, les fautes exclusives du médecin ne devraient donner lieu qu’à une responsabilité exclusive de celui-ci. Il semble que de tels jugements soient possibles à cause de la méconnaissance que certains experts ont de la profession de sage-femme et induisent le plus grand flou quant à la recherche des responsabilités de chaque praticien.

Abstract (English)  :

ollaboration between midwives and physicians during births is very common. As there are some difficulties separating the respective responsibilities between them in the event of litigation, the author aims to identify solutions emanating from decisions based on case law analysis. The latter are divergent due to interpretation of the laws relative to the midwife profession. As the solutions are dependent on the ambiguous laws concerning the midwife profession, some judgements decide that the responsibility lies exclusively with the midwife or physician, although others recognise shared responsibilities between midwife and physician. After study of the relative cases, the author remains surprised by certain decisions, especially those related to shared responsibility, and proposes the hypothesis that it is not always obvious for judges to distinguish the realm of midwife responsibility from that of the physician. Though it seems obvious that it is logical to hold midwives accountable for their acts due to the independence that they enjoy in exercising their professional activity, it is always surprising when physicians are held responsible for poor monitoring of labouring women or newborns by the midwife. This is especially so since midwives have no subordinate relationship with physicians and each is a partner in the collaboration with their own respective expertise, and each is solely responsible for not committing any errors. On the other hand, the exclusive errors of physicians should only be imputable to themselves. It appears that such rulings are possible due to the ignorance that some experts have of the midwife profession and the considerable confusion induced in the quest for identifying the responsibilities of each practitioner.
